1. Agreement to Terms
By accessing or using the TravelVault platform, mobile application, website, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
If you are using the Service on behalf of an organization (such as an airline, airport operator, or security agency), you represent that you have the authority to bind that organization to these Terms.
2. Description of Service
TravelVault provides an AI-powered pre-clearance and compliance platform for air travel. The Service enables users to scan and classify items, evaluate compliance against applicable travel regulations, and generate digital pre-clearance passes.
Important Advisory Notice
TravelVault provides advisory compliance assessments only. Pre-clearance passes do not constitute official government clearance. Security personnel and regulatory authorities retain full and final authority over all screening and clearance decisions. TravelVault does not replace, override, or supersede any government security process.
3. User Accounts
To use certain features of the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use.
You agree to provide accurate, current, and complete information during registration and to update such information as necessary.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Submit false, misleading, or fraudulent information
- Attempt to circumvent security measures or access controls
- Interfere with the operation or integrity of the Service
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to facilitate the transport of prohibited or illegal items
- Represent TravelVault assessments as official government clearance
5. Compliance Decisions
Compliance decisions provided by TravelVault are based on our interpretation of publicly available regulations and are provided for informational purposes only. Regulations vary by jurisdiction, airline, and airport and may change without notice.
TravelVault does not guarantee the accuracy, completeness, or timeliness of compliance assessments. Users are ultimately responsible for ensuring their items comply with all applicable laws, regulations, and airline policies.
6. Pre-Clearance Passes
Digital pre-clearance passes are advisory documents summarizing TravelVault's assessment of declared items for a specific trip. They are not government-issued credentials and do not entitle the bearer to expedited screening or any preferential treatment unless explicitly arranged through a participating airline or airport partner program.
7. Enterprise and Airline Partners
Airline partners, airport operators, and other enterprise users may be subject to additional terms under separate agreements. In the event of conflict between these Terms and an enterprise agreement, the enterprise agreement shall prevail.
8. Intellectual Property
The Service, including its design, code, content, algorithms, classification models, rule engines, and documentation, is the property of TravelVault and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
9. Limitation of Liability
To the maximum extent permitted by applicable law, TravelVault and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, revenue, or profit, arising out of or related to your use of the Service.
TravelVault's total liability for any claim arising from the Service shall not exceed the amount you have paid to TravelVault in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. TravelVault does not warrant that the Service will be uninterrupted, error-free, or that compliance decisions will be accurate or complete.
11. Indemnification
You agree to indemnify and hold harmless TravelVault from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any law or regulation.
12. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to conflict of law principles.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms and updating the effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
